The aim of this study is to briefly set out and clarify the reasons why the effectiveness of the authentic instrument is superior to that of any other document, namely because it enjoys public trust. We need to begin by stating the obvious. Documents having legal content and effects exist since man learned to express himself through writing. Among these, there are also those documenting legal transactions among individuals. Starting from this, some formulations were gradually found, in order to improve their effectiveness thanks to the addition of guarantees during their formalisation.
