Following the interest generated during the UINL Congress and international academic conferences in Hannover, Nancy, and Tokyo, the International Union of Notaries (UINL) is pleased to announce the update and full publication of the study on the economic function of the Notariat.
Responding to the requests of numerous notariats who, following the presentation at the Berlin congress, asked for an official scientific reference, we are now providing the link to the article published in the Italian Review of Economics, Demography and Statistics (RIEDS).
The study has been integrated with data from the World Bank’s new “B-Ready” (Business Ready) report, extending the analysis to approximately 100 countries. The empirical evidence is unequivocal: the expanded sample confirms that systems with a Latin Notariat demonstrate superior performance in protecting legal certainty and reducing macroeconomic transaction costs.
Special mention goes to the further analysis of the “Business Location” theme of the B-Ready project (subject of a forthcoming study note), in which Italy ranks first globally regarding the real estate property transfer index. This leadership position certifies worldwide that an ecosystem based on the synergy between the Notariat, digitalization, and interconnected, reliable public registries represents the frontier of efficiency. The continental Civil Law notarial model is no longer merely a tradition but the cutting-edge benchmark for market competitiveness. Although the sample will be expanded with the analysis of approximately 80 additional countries, this is the first time in the last ten years (and the first time ever among countries with more than 4 million inhabitants) that a country with a Latin Notariat has ranked first in a World Bank ranking related to property transfers.
The latest results of the UINL notariats’ performance study rest on an internationally renowned research team:
-Prof. Bruno Deffains (Paris Panthéon-Assas University), distinguished economist and a benchmark in the economic analysis of regulation and Law and Economics;
-Dr. Claudio Ceccarelli, Director at the National Institute of Statistics (Istat), high-profile statistical expert and guarantor of methodological rigor;
-Dr. Antonio Cappiello, economic expert with relevant international publications on the economic analysis of the Notariat.
Beyond mere efficiency, the Notariat remains a frontline service of proximity for citizens, providing a guarantee of impartiality and third-party neutrality. Under this vision, the notarial function acts as an essential pillar of equity and transparency, specifically designed to support vulnerable individuals and ensure that the digital and economic evolution of legal systems never compromises human protection and social justice.
